Andrew R. Wiener

Andrew Wiener brings 39 years of employment and business litigation experience to his full-time mediation practice. As Wiener has mediated hundreds of cases involving claims of wrongful termination, sexual harassment, breach of employment contract, defamation, wage & hour entitlement, and/or age, race, gender or disability discrimination, he brings a wealth of employment law knowledge and creativity to the resolution of workplace conflicts.
Having been lead or sole counsel in civil jury or court trials in a wide range of business matters in both federal and state court, in both southern and northern California, and for both Plaintiffs and Defendants, Wiener also provides valuable insights into the potential outcomes litigants face, helping mediation participants understand both the upside and downside of continuing conflict, as well as the alternatives open to them.
Wiener has also been a fee dispute arbitrator for many years and thus intimately familiar with the aspects of such conflicts.
Wiener does not adhere to a singular mediation process or philosophy; rather, he tailors his approach to match the dynamics and context of each conflict, as initially identified in pre-session teleconferences with counsel. Special attention is made pre-session to identify information that the participants feel they need before a session starts to enable them to make informed settlement decisions.
Wiener is a 1980 graduate of Brown University (Providence, RI) and obtained his law degree in 1983 from the McGeorge School of Law (Sacramento, CA), where he was a member of the Moot Court Honors Board. Wiener has also been a two-term member and Chair of the City of Oakland Public Ethics Commission.
Wiener conducts mediation in person, via Zoom or telephonically, as appropriate to the circumstances.
