Mark J. Divelbiss has been a certified litigation mediator since 2001 and has over 60 hours of mediation specific training. He has conducted over 200 different mediations and settlement conferences and has successfully resolved a high percentage of all his cases. He organized and executed a two-day mediation seminar in London, England. Divelbiss has published mediation articles, including one for the San Francisco Daily Journal entitled "Mediation Is Not as Confidential or as Voluntary as Attorneys Might Think," (April 15, 2002).

Divelbiss has been trained and is willing to conduct remote mediations and help both clients and counsel become familiar with the process. Remote mediations can and mostly likely will include break out rooms to allow confidential discussions with just the mediator outside the video and audio presence of the other counsel and party.

Divelbiss' style is considered facilitative in nature, focusing on the parties' previous lack of communication on emotional issues to create opportunities for resolution. His ability to handle the psychological components of mediation as well as the factual and legal issues involved have been recognized as significant characteristics of his in settling disputes. Divelbiss has received several written accolades from the judges of both San Francisco and Contra Costa Superior Court commending his success in resolving cases and serving as a settlement Judge Pro Tem. In addition, attorneys who have used him commend his character, professionalism, and, most significantly, his ability to allow parties to be heard, all necessary components for successful mediations.

As a trial attorney for 30 years, Divelbiss has represented individuals and companies in employment, business and real estate disputes. His practice also encompasses construction defect litigation, insurance coverage disputes and personal injury matters. In addition, he has significant experience in appellate work, including arguing several cases before the California Courts of Appeal.

Divelbiss graduated from Santa Clara University in 1986 and received his Juris Doctorate degree in 1989 from the University of San Francisco upon graduating Cum Laude. Divelbiss is admitted to practice in California and Washington.
