Full Scope-Focused: Intro to Consumer Debt and Defense

What: In addition to once monthly free clinics for low income clients held by the Consumer Advocacy Project (CAP), volunteer attorneys also take on full scope representation cases outside of the clinic. In these cases, a volunteer attorney works with a single client for the remainder of the case. Because clients can be made eligible for placement with an attorney for full scope representation at any time during the case, the time commitment for an attorney can be as little as 4 hours for substituting in before trial (including trial prep) to 18 hours when starting at the Answer phase.

The training covers all the common issues attorney volunteers will see in a debt defense case, as well as provide detailed instructions for a defense strategy. Topics include:

  • "Overview of Debt Collection Litigation"
  • Responding to a lawsuit
  • Potential FDCPA and RFDCPA violations
  • Case Management Conference how-to
  • ADR considerations
  • Discovery options
  • Potential motions (uncommon occurrences)
  • Limited Jurisdiction special rules (C.C.P §90-100)
  • Trial preparation

Who: This course is best suited for new attorneys, and any attorney unfamiliar with civil litigation, especially in Limited jurisdiction matters. This training is not required for volunteers who'd like to take a full scope case, but is very helpful. Because mentorship is provided, inexperienced attorneys are encouraged to volunteer.
