Showing Lawyers How to Succeed in Mediation
Presented by Roger Allen and Malcolm Sher

Two experienced Bay Area mediators offer this four-hour training, specially designed for lawyers with little or no experience representing clients in mediation. You will learn not only traditional, but also innovative and even controversial ideas for preparing the case, clients and stakeholders, as well as the mediator for the "mediative process." This program is full of proven practice tips for lawyers to fully engage in the process of creating a strategic plan that really works. These will include collaborating on an efficient, yet economic plan for sharing information, identifying and meeting clients' and lawyers' financial and other goals, needs and interests. The presenters will share with you the choreography of the "negotiation dance." They will offer flexible ideas to address potential impasse. Finally, they will provide suggestions on how to "close the deal."

Trainer: Malcolm Sher
A full-time neutral since 2009, Malcolm has mediated hundreds of real estate, landlord-tenant, contract, partnership, probate/trust, employment, legal and broker malpractice, attorney fee and personal injury disputes; over 75% are high-emotion cross-cultural cases.

After earning his law degree from London University in 1969, he practiced law in the U.K. for five years. He was admitted to the California Bar in 1976. He was trained at Pepperdine University's Straus Institute for Dispute Resolution and at The Harvard Negotiation Project. Co-author of the ADR chapter of CEB's "Real Property Remedies and Damages," he has published extensively in the LA and SF Daily Journals, local bar association journals and Mediate.com. He is a founder member of the California and National Academies of Distinguished Neutrals and is Vice Chair of The Mediation Society. He serves on the State Bar's Executive Committee on ADR.

Malcolm is a MSC Officer for SF Superior Court, is on the BASF Mediator Panel and the ADR and the Settlement Mentor panels of several Bay Area courts.

Trainer: Roger Allen
Roger litigated in all courts of the Bay Area from 1977 through 2014. During the last 30 years of his practice he meditated and arbitrated hundreds of cases. Since retirement from litigation in August of 2014 he devotes all of his professional time to mediation and arbitration.

Roger has tried numerous jury cases to verdict and handled a broad range of civil cases, including construction site accident, automobile, slip and fall, products liability, construction defect, psychologist malpractice, inverse condemnation, debt collection, government tort liability, insurance coverage, sexual molestation, and uninsured/underinsured motorist.

Roger has mediated over 300 matters, including the types listed above plus wrongful foreclosure. He is on mediation panels of the Alameda and Contra Costa County Courts and serves as day of trial settlement commissioner for Contra Costa and Marin County Superior Courts and is on the Alameda County Bar Association ADR Executive Committee. He is a neutral arbitrator of medical malpractice cases brought by patients against Kaiser Permanente.

He has trained as a mediator with the Strauss Institute at Pepperdine University and Steven Rosenberg Mediation.
